1. Acceptance of Terms
By accessing or using XScapeKit, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of the terms, you may not access the service.
2. Description of Service
XScapeKit is a platform for creating and experiencing interactive visual novels. Users can:
- Create interactive stories using our visual editor
- Publish stories for others to play
- Play stories created by the community
- Save progress and track played stories
3. User Accounts
Registration
To use XScapeKit, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials.
Account Types
- XPert (Creator): Users who create and publish stories
- XPlorer (Player): Users who play stories
A single account can be used for both creating and playing stories.
4. User Content
Ownership
You retain ownership of the stories and content you create on XScapeKit. By publishing content, you grant XScapeKit a license to host, display, and distribute your content on the platform.
Content Guidelines
You agree not to create or publish content that:
- Infringes on intellectual property rights
- Contains illegal material
- Promotes violence, hatred, or discrimination
- Contains malware or harmful code
- Impersonates others or misrepresents your identity
- Violates any applicable laws or regulations
Content Moderation
We reserve the right to remove content that violates these terms and to suspend or terminate accounts of repeat offenders.
5. Acceptable Use
You agree not to:
- Use the service for any illegal purpose
- Attempt to gain unauthorized access to the platform
- Interfere with or disrupt the service
- Scrape or collect data without permission
- Create multiple accounts to evade bans or restrictions
- Use automated tools to access the service without permission
6. Messaging & Communication
Direct Messaging
XScapeKit enables direct messaging between creators and players. Messages are a reflection of both parties and must comply with our content guidelines.
Player Conduct
Players using the messaging feature agree to:
- Communicate respectfully and professionally
- Not send harassing, abusive, or threatening messages
- Not send spam or unsolicited promotional content
- Respect creator boundaries and response times
Players found abusing the messaging system may have their messaging privileges revoked and accounts suspended or permanently banned.
Creator Conduct
Creators using the messaging feature agree to:
- Provide reasonable value for paid messaging interactions
- Not prematurely close paid message threads to circumvent pricing
- Respond to paid messages in a timely manner
- Report abusive players rather than retaliating
Creators found attempting to circumvent messaging pricing or engaging in deceptive practices may be subject to account restrictions, loss of monetization privileges, or permanent bans.
Message Moderation
All messages are subject to review for policy violations. We reserve the right to access message content for moderation purposes, abuse prevention, and to respond to legal requests. Both parties may report messages for review.
7. XO Virtual Currency
About XO
XO is the virtual currency used on XScapeKit. Users purchase XO to access creator content, subscribe to creator tiers, and pay for premium features like paid messaging.
Purchases & Refunds
- XO purchases are final and generally non-refundable
- Refunds may be issued at our discretion for service issues
- Creator subscriptions auto-renew unless cancelled
- Unused XO remains in your account indefinitely
Creator Earnings
- Creators earn XO from subscriptions, content sales, and paid messages
- Platform fees apply to creator earnings (see fee schedule)
- Minimum payout threshold applies to withdrawals
- Earnings from fraudulent activity will be reversed
Prohibited Activities
Manipulation of the XO system, including but not limited to fraudulent purchases, chargebacks, or artificial inflation of earnings, is strictly prohibited and may result in account termination and legal action.
8. Intellectual Property
XScapeKit and its original content (excluding user-created content), features, and functionality are owned by XScapeKit and are protected by international copyright, trademark, and other intellectual property laws.
9. Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service will immediately cease.
10. Disclaimer of Warranties
XScapeKit is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, XScapeKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes by posting the new terms on this page. Continued use of the service after changes constitutes acceptance of the new terms.
13. Governing Law
These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.
